Sex Offender Registration
SEX OFFENDER IN CARROLL COUNTY ARKANSAS
Sex offenders are required to register in Arkansas. Details on the Sex Offender Registration Act of 1997 can be found in Arkansas Code Annotated §12-12-901 - 12-12-920.
WHO IS REQUIRED TO REGISTER?
Any individual who is convicted of certain sex offenses and offenses against children.
Any individual who was incarcerated, on probation or parole, or serving any other form of community supervision as the result of an adjudication of guilt for the listed offenses as of this Act's effective date.
Any person who is acquitted on the grounds of mental disease or defect for the listed offenses.
Any person who was required to register under the Habitual Child Sex Offender Registration Act, Arkansas Code Annotated §12-12-901.
A sex offender moving to or returning to this state from another jurisdiction shall register with the local law enforcement agency having jurisdiction within 3 business days of establishing residency.
FAILURE TO REGISTER
A person who fails to register, who fails to report changes of address or fails to comply with assessment as required, shall be guilty of a Class C felony.
REGISTERED SEX OFFENDERS ON THE WEB
All registered sex offenders in the State of Arkansas are required to submit to assessment by the Sex Offender Screening & Risk Assessment Program coordinated by the Arkansas Department of Correction. Each offender is assigned a risk level based on the results of the assessment. Offenders failing to submit to assessment are assigned default Risk Level 3.
Arkansas Code Annotated §12-12-913 (j)(1)(A), mandates that information on registered sex offenders determined to pose the highest level of risk to the public (Level 3 and Level 4), must be available on the Arkansas state website by January 1, 2004. Recent changes in the law have added public access to information regarding Level 2 offenders who were 18 or older and the victim was 14 or younger at the time of the offense.
Based on information obtained from the risk assessment process, offenders are assigned the following levels:
- Level 1: Low Risk
- Level 2: Moderate Risk which has 2 classifications (HIGH and LOW)
- Level 3: High Risk
- Level 4: Sexually Violent Predator.

The Carroll County Sheriff's Office is the law enforcement agency that handles the registration process of Sex Offenders who reside in Carroll County and Holiday Island the other municipalities including Berryville, Eureka Springs, and Green Forest register the Offender within their city limits.
What are the different levels and what do they mean?
In Arkansas, sex offenders are classified into four levels (1-4) based on their risk of reoffending, with Level 4 being the highest risk. These levels determine community notification requirements and other restrictions. Level 1 offenders have the lowest risk of reoffending, Level 2 is moderate, Level 3 is high, and Level 4 are considered sexually violent predators.
Here's a more detailed breakdown:
Sex Offender Community Notification Levels
Level 4 (Red)
Sexually Dangerous Person. These are individuals with impaired judgment or control who have sexual or violent compulsions that they lack the ability to control. This may be due to pedophilia or other disorder of sexual attraction mental illness or personality disorder that distorts thinking, interferes with behavioral control, and predisposes the person to acts of predatory sexual violence.
Level 3 (Yellow)
High Level. These individuals usually have histories of repeat sexual offending, and/or strong antisocial, violent or predatory personality characteristics. Sexual compulsions are likely to be present, but may be kept under control when relapse prevention plans are followed and treatment is continued. The offense patterns of these individuals reflect a relatively high probability of re-offense and/or a risk of substantial injury to victims should re-offense occur.
Level 2 High (Dark Green)
Moderate Level. Usually these are individuals with limited or circumscribed prior history of sexual acting out, possess some antisocial personality characteristics, predatory tendencies, or deviant sexual interest or behavioral patterns that increase the general level of risk these offenders pose. They may have mild or well-controlled mental disorders, and/or developmental disabilities.
Level 2 Low (Light Green)
Moderate Level. Usually these are individuals with limited or circumscribed prior history of sexual acting out, possess some antisocial personality characteristics, predatory tendencies, or deviant sexual interest or behavioral patterns that increase the general level of risk these offenders pose. They may have mild or well-controlled mental disorders, and/or developmental disabilities.
Level 1 (White)
Low Level. Usually these are individuals with no prior history of sexual acting out, and no strong antisocial tendencies, sexual compulsions or psychological factors impairing judgment.
Non-Assessed (Blue)
This individual has not yet been assigned a Community Notification Level by SOCNA (Sex Offender Community Notification Assessment).
